3. Information we hear but do not keep
To enroll you, your electricity provider may ask for your Social Security number or ITIN, date of birth, driver's license number and a payment card or account. If you give us that information during a call, we use it only to complete the enrollment at that moment. We do not write it down, we do not store it in any system, and we do not record the call. After enrollment, that information is held by your provider under its own privacy policy.
Your membership payment is processed by Stripe. We never see or store your full card number.
4. How we use your information
- Calculate your savings and prepare your report.
- Enroll you in the plan you confirm and speak with your provider about that enrollment.
- Apply our guarantee and review your plans at each renewal.
- Charge and renew your membership, and apply referral credits.
- Send you reminders, notices and reports.
- Send you promotions, unless you have unsubscribed.
- Comply with the law and PUCT rules.
5. Who we share information with
We do not release your information to anyone without your written authorization, except as needed to provide the service you requested or as required by law. We share only with:
- Retail electric providers (REPs): to enroll you in the plan you confirmed, and to show our agent authorization if the REP asks for it.
- Smart Meter Texas and your utility: for the data sharing agreement you approve or the usage letter of authorization you sign.
- Stripe: to process your membership payment.
- Technology providers working for us: Amazon Web Services (website and database), Google Firebase (website features), Zoho (email) and Meta's WhatsApp (messages). [Google Ads, once we start advertising.]
- Professional advisors, such as attorneys and accountants, when necessary.
- Authorities, such as the PUCT, when the law requires it.
- A buyer, if we sell or merge the business in the future. We would notify you first, and this policy would continue to apply to your information.
6. We do not sell your information
We do not sell, rent or trade your personal information, including a "sale" as defined by the Texas Data Privacy and Security Act.
7. Cookies and advertising
Our website uses cookies it needs to work. We may use cookies and third-party measurement tools, such as Google's, to learn which ads bring visitors and to show ads on other websites. You can decline cookies in your browser and opt out of targeted advertising by writing to info@affordablekilowatts.com. If your browser sends a Global Privacy Control signal, we treat it as an opt-out request for that browser.
8. Security
- Your information travels encrypted (HTTPS) and is stored on servers with restricted access.
- Only staff who need it to serve you can see it, using strong passwords and two-step verification.
- We do not store Social Security, ITIN or card numbers.
- If a security breach affects your information, we will notify you as Texas law requires.
9. How long we keep your information
- General customer information: 12 months after your membership ends. If you never became a member, 12 months after our last contact.
- Broker records (agent authorizations, enrollment records and EFLs): 2 years, as PUCT rules require.
- Payment records: as long as tax law requires.
- Smart Meter Texas: we end the data sharing agreement within 30 days after your membership ends.
At the end of each period, we delete the information or make it anonymous.
10. Your rights
If you live in Texas, you can ask us to:
- tell you what information we have about you and give you a copy;
- correct inaccurate information;
- delete your information (except what the law requires us to keep);
- opt you out of targeted advertising.
Write to info@affordablekilowatts.com. We may ask for information to confirm your identity. We respond within 45 days; if we need 45 more days, we will tell you why. If we deny your request, you can appeal by writing with the subject "Privacy appeal"; we respond within 60 days. If the appeal is denied, you can file a complaint with the Texas Attorney General at texasattorneygeneral.gov. We will not treat you differently for exercising these rights.
11. Minors
Our service is only for people 18 or older. We do not knowingly collect information from minors.
12. Changes to this policy
If we make a material change, we will email you and post the new date above. If we ever decide to store payment or identification information for automatic renewals, we will update this policy and ask for your permission before storing anything.
