1. Who we are
Affordable Kilowatts LLC ("Affordable Kilowatts," "we," "us") is an electricity broker registered with the Public Utility Commission of Texas (PUCT), registration number BR250002. We help households compare electricity plans and enroll with a retail electric provider ("REP"). We do not sell electricity. Your electricity contract is between you and the REP, and the REP is responsible for your service, prices and bill.
By paying for a membership, signing our Agent Authorization or using our website, you accept these Terms.
2. How we are paid
Our only income is the membership you pay. We do not receive commissions or payments from electricity providers for recommending a plan or enrolling a customer.
3. Who can use the service
- You must be 18 or older and have authority to make electricity decisions for your household.
- We only serve addresses in Texas areas with retail choice (deregulated areas). If your electricity comes from a co-op or a municipal utility, we cannot help you change plans.
- You may authorize another person in writing (for example, your spouse) to speak with us and make decisions on your account.
4. The membership
Price: $120 per year, per electric meter (ESI ID). Each meter needs its own membership.
What it includes:
- A savings report with your usage and our plan recommendation.
- Help enrolling in the plan you choose, including by phone.
- A reminder before your electricity contract expires.
- A plan review at each membership renewal.
What it does not include: billing, payment, deposit, disconnection or service problems with your REP. For those, contact your REP and, if not resolved, the PUCT (section 17). For outages or emergencies, call your utility (for example, Oncor).
Free website information: quick estimates can be used without a membership. Plan prices come from Power to Choose, show the date they were checked, and can change. Each plan's Electricity Facts Label (EFL) controls.
5. Billing, renewal and cancellation
- First charge: we only charge after confirming your estimated savings cover the membership (section 6). We will tell you before we charge.
- Payment: payments are processed by Stripe. Stripe stores your card; we only see the card brand, last four digits and expiration date.
- Automatic renewal: your membership renews every year on the same date. By signing up, you authorize a $120 charge per meter at each renewal until you cancel. We will email you a notice at least 15 days before each renewal.
- How to cancel: at any time, through the Stripe link in our emails, by writing to info@affordablekilowatts.com, or by calling us. To avoid the next charge, cancel before the renewal date. When you cancel, the membership stays active until the end of the paid year and does not renew.
- Declined payment: if your card is declined at renewal, the membership ends. We do not charge late fees or send accounts to collections.
- Price changes: we will email you at least 30 days before the renewal at which a new price applies.
6. Our guarantee
First year. If you already have an electricity contract and we do not find estimated savings of at least $120 over 12 months, calculated with your usage and after subtracting any early termination fee, we do not charge the membership. If you choose to switch anyway for convenience or peace of mind, the membership is charged, and we will tell you before making the switch.
Renewal. On the renewal date we compare the plan we recommend with the average of all plans offered in your area on Power to Choose that day, including plans with bill credits, incentives or time-of-use pricing. Each plan is priced with your last 12 months of usage from Smart Meter Texas. If the recommended plan does not cost less than that average, we do not charge that year's renewal and your membership continues. If we do not have Smart Meter Texas data, we will use the usage on your bills.
7. Savings are estimates
Our reports and savings figures are estimates. They are based on your usage, the prices published in each plan's EFL, and the information available when we run the calculation. Your actual bill will vary with your usage, the weather, utility delivery charges, taxes and other factors outside our control. We do our best, but we do not guarantee that our calculations are 100% accurate or any specific result on your bill.
If you believe one of our calculations is wrong, contact us within 30 days and we will review it. If the error changes the result of the guarantee, we will apply the guarantee using the corrected calculation.
8. Refunds
Except as provided in our guarantee (section 6) or required by law, we do not issue refunds. If you cancel mid-year, there is no refund for the unused portion. Any other refund is at the sole discretion of Affordable Kilowatts, which may deny it for any reason.
9. If you move
- If you keep the same plan at your new address (when your REP allows it), your membership continues unchanged.
- If a new enrollment is needed at your new address, a new membership year starts that day. We credit $10 for each full unused month of your previous membership. The credit is applied to the new $120 charge and is not a refund.
Texas rules generally let you end a fixed-rate contract without an early termination fee when you move, if you notify your REP and give proof of the move. Confirm the conditions with your REP.
10. Early termination fees
If you are still under a fixed-rate contract, your current REP may charge an early termination fee ("ETF") if you switch before it expires.
- We will tell you the ETF shown on your EFL or bill before you decide. You should confirm the amount with your REP.
- Our savings estimates show the result after subtracting the ETF.
- You decide whether to switch. The ETF is charged by your current REP and you are responsible for paying it. Affordable Kilowatts does not pay or reimburse it.
- If the ETF wipes out the savings, we will recommend waiting. Texas rules generally do not allow an ETF if you switch within the last 14 days of your contract.
11. Enrollment and agent authorization
- Before we enroll you, you sign our Agent Authorization. It lets us act as your limited agent to enroll you with a REP and speak with the REP about your enrollment.
- We never switch your plan without your confirmation. For each enrollment you confirm the REP, plan name, price, term and ETF, and you receive links to the EFL, the REP's Terms of Service and the "Your Rights as a Customer" document.
- The REP may ask for your Social Security number or ITIN, date of birth and a payment card or account, and may run a credit check or require a deposit. Those decisions are the REP's.
- If you give us that information during the call, we use it only to complete the enrollment at that moment. We do not write it down, we do not keep it, and we do not record calls. We will never ask for that information by text, WhatsApp or email.
- Texas rules generally let you cancel a new electricity contract without penalty within 3 federal business days after receiving the REP's Terms of Service.
- You may withdraw the Agent Authorization at any time by writing to info@affordablekilowatts.com. Without it, we cannot enroll you.
12. Smart Meter Texas
With your permission, we request a data sharing agreement in Smart Meter Texas using our third-party account. You approve it from an email Smart Meter Texas sends you. The agreement lasts up to 12 months and lets us see your electricity usage. We use it only to calculate your savings and the guarantee. We end the agreement within 30 days after your membership ends, and you can cancel it at any time in Smart Meter Texas.
13. Referral program
- For each person you refer who pays for their first membership, you receive a $10 credit.
- The credit is applied automatically to your next renewal. Credits add up to a maximum of $120 per year.
- Credits have no cash value, cannot be transferred, and are lost if your membership ends.
14. Communications
- We will send you operational messages by email, text, WhatsApp or phone: billing and renewal notices, contract expiration reminders, enrollment confirmations and reports. They are part of the membership and cannot be turned off while it is active.
- You can stop promotional messages at any time by replying STOP or using the unsubscribe link.
- Message and data rates from your carrier may apply. WhatsApp is a Meta service with its own privacy terms.
- We do not record calls.
- Keep your email and phone number up to date. We are not responsible for messages sent to contact information you did not update.
15. Your responsibilities
You agree to give us accurate and complete information, not to use the service for an address or account without the account holder's authorization, and not to use the website for anything unlawful. If you give false information or act without authorization, you are responsible for the resulting claims and costs.
16. Limitation of liability
- The website and service are provided "as is." We are not responsible for what REPs, utilities, Smart Meter Texas or Power to Choose do or fail to do, or for website interruptions.
- To the extent the law allows, our total liability to you is limited to the membership fees you paid us in the 12 months before the claim, and we are not liable for indirect, special or consequential damages.
- Nothing in these Terms limits rights that Texas law does not allow to be limited.
17. Complaints

18. Governing law
These Terms are governed by Texas law. Any dispute will be brought in the courts of Dallas County, Texas, including small claims (justice court).
19. Changes to these Terms
We may change these Terms. If the change is material, we will email you at least 30 days before it applies. If you do not agree, you may cancel before that date.
20. Language
These Terms exist in Spanish and English and both versions have the same effect. If they differ, the version in the language you chose when you signed up applies.

Our Privacy & Security Policy is part of these Terms.
